The following are the terms of service you agree to in order to use our site. Please check periodically for any updated terms as terms may change without notice. By accepting these terms of service, you also agree that your use of our website may contain links to restaurant websites which may be governed by separate user agreements. We are not responsible for content on linked websites.

Using Dr. Eats.com
Costs for the hungry: Joining Dr. Eats and finding delivery to your area is free. Placing an online order or contacting the restaurant to place an order is free. The charge for delivery is determined by the individual restaurant and may change at the discretion of said restaurant with or without notice to Dr. Eats. The cost of menu items also may change without notice, so please verify your total and all charges with the restaurant.

Costs for the restaurant: Your basic menu is initially posted free of charge. You will be contacted before this promotional period ends. If you choose not to participate, your menu may be removed wholly or in part but your contact information may remain in order to provide a comprehensive listing to the consumer. We agree to never knowingly post incorrect information and are not liable for mistakes or lack of updating to our non-participating listings. Costs for participation and programs are not listed here- please contact a sales representative. Costs may change over time, but you will be given notice and may choose to accept or change status.

Legal:
Use of site as a search tool for customers to order direct from you : We are not responsible. For anything. As a search tool, DrEats.com is an information site that offers customers a geographical search for menus available at the time of posting. We have no affiliation to restaurants posting basic menus. We offer no guarantee for timeliness of delivery, quality of food, or accuracy of menu items. Please verify with the customer costs, times, and order details at the time they call you to place the order. We are also not responsible for customer lack of payment, customer giving a wrong address, or customer complaints. In the event of a dispute between customer and restaurant, you release us from claims, demands and damages (actual and consequential) arising from or in any way connected with such disputes. We hope our site has resulted in a positive delivery experience, but, if not, it’s not our fault.

Use of site by customers to order food through DrEats Online Ordering System : We guarantee that when a customer places an order through the DrEats Online Ordering System (OOS), you will receive the order exactly as it is input and all charges will be accurate according to costs/fees you have posted at the time of ordering. We are not responsible for customer mistakes in inputting their orders or address. You are responsible for updating your menu items (including daily items that are 86'd), price changes, and other costs/fees. You will receive the order within minutes of its placement. We are not responsible for your staff's timeliness in checking your computer or fax for new orders. Please place the computer or fax in high traffic areas and instruct staff to check it regularly. We are not responsible for orders missed due to equipment malfunction, improper use, or neglect. If you are receiving orders via computer, be sure your computer is powered on, connected to the internet, and logged in to the OOS. Have the email program open and check incoming emails regularly. If orders are sent by fax, be sure your fax is online and operational and that there is plenty of paper and toner. Again, we are not responsible if you do not. If the customer is unhappy with their order, we require them to contact you to attempt to resolve the issue. If you are unable to resolve the issue and wish to offer the customer a full or partial refund, you are required to notify us within 24 hours to issue the refund. Send an email to disputes@dreats.com with the order date, restaurant name, staff member name at the restaurant that approved the refund, customer name, total amount of bill, dollar amount due to customer, and a brief explanation. If the daily ACH payment to you has already been processed, then the customer refund will be withheld from your next ACH or billed separately to your restaurant, at the discretion of DrEats.com. No refunds will be given to the restaurant for the online ordering fee or credit card processing fee associated with the refunded order. In the event that you do not approve a customer refund and the customer institutes a credit card chargeback, you will be responsible for all fees incurred. In summary, we are only responsible for the accuracy of the transmittance of the customer's online order.

Any and all use of site : We are not liable for any loss of money, goodwill, or reputation, indirect, or consequential damages arising out of use of our site. You will indemnify and hold us harmless from any claim or demand, including any attorney's fees, made due to or arising out of any user's breach of this agreement, or your violation of any law or the rights of a third party.

Privacy:
In order to place a delivery order, whether through us or any other means, certain geographical and payment information must be given to the restaurant. We are not responsible for what the restaurant does with this information once received. Information entered on our site will not be given, sold, or otherwise transferred to any party outside the transaction at any time. We may, however, use your contact information for internal marketing purposes. You may opt out of marketing at any time by using the opt out contact information included in said materials.
